8. Payment Terms
When you place an order through the Website, you agree to pay all applicable charges, including the price of the food items ordered, delivery fees (where applicable), applicable taxes, and any other charges disclosed at the time of checkout. All prices are displayed in United States Dollars (USD) unless otherwise specified.
8.1 Payment Methods
We accept payment via the methods listed on our checkout page, which may include major credit cards, debit cards, and other digital payment options. By providing your payment information, you represent and warrant that you are authorized to use the designated payment method and that the information you provide is accurate and complete.
8.2 Pricing and Taxes

8.3 Refunds and Cancellations
Orders may be cancelled within a limited window after placement, as described in our refund policy. Once food preparation has begun, cancellations may not be possible. These service providers operate under their own terms and policies, though we require them to maintain the confidentiality and security of your personal information.
10. Disclaimers — Services Provided "As-Is"
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ALL SERVICES, CONTENT, AND MATERIALS MADE AVAILABLE THROUGH IT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
PUNCH PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE WEBSITE, INCLUDING MENU DESCRIPTIONS, PRICING, OR NUTRITIONAL INFORMATION;
- WARRANTIES THAT ORDERS WILL BE FULFILLED WITHIN ANY SPECIFIC TIMEFRAME; AND
- WARRANTIES REGARDING THE QUALITY, SAFETY, OR SUITABILITY OF ANY FOOD PRODUCTS BEYOND WHAT IS REQUIRED BY APPLICABLE FOOD SAFETY REGULATIONS.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. To the extent that applicable law does not allow the disclaimer of certain warranties, those warranties are limited to the minimum extent permitted by law.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES FEDERAL AND STATE LAW, IN NO EVENT SHALL PUNCH PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or goodwill;
- Cost of substitute goods or services;
- Damages arising from unauthorized access to or alteration of your transmissions or data;
- Damages arising from the conduct of third parties using the Website;
- Any damages resulting from reliance on information obtained through the Website; or
- Any other matter relating to the Website or services.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
SOME STATES DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
12. Indemnification
You agree to defend, indemnify, and hold harmless Punch Pizza and its officers, directors, employees, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use or misuse of the Website or any of our services;

- Your fraud, negligence, willful misconduct, or other wrongful conduct; or
- Any dispute you have with another user of the Website or any third party.
We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses and in providing any information we reasonably request. You shall not settle any such claim without our prior written consent.
13. Food Allergies and Dietary Information
Our menu items may contain or may have been prepared in facilities that handle common food allergens, including but not limited to wheat, gluten, dairy, eggs, tree nuts, peanuts, soy, fish, and shellfish. While we make reasonable efforts to provide accurate ingredient and allergen information on our Website, we cannot guarantee that any menu item is entirely free from allergens due to shared preparation equipment or cross-contamination risks in our kitchen.
14. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the United States of America and applicable state law, without regard to any conflict of law principles that would require the application of the law of any other jurisdiction.
You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the federal or state courts of competent jurisdiction located in the United States. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection you may have based on improper venue or inconvenient forum.
These Terms are subject to applicable United States federal law, including but not limited to the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) concerning unfair or deceptive acts and practices, and any applicable state consumer protection statutes. If you are a California resident, additional rights may be available to you under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), as detailed in our Privacy Policy.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Website informally by contacting us at [email protected] with a written description of your dispute. We will attempt in good faith to resolve the dispute within thirty (30) days of receiving your written notice. If the dispute is not resolved within that period, either party may proceed with the dispute resolution procedures set forth below.
15.2 Binding Arbitration
EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR YOUR USE OF THE WEBSITE, SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, RATHER THAN IN COURT.
Arbitration proceedings shall be conducted in English, and the arbitrator's decision shall be final and binding. The arbitrator shall have the authority to award any remedy that would be available in a court of law. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
15.3 Class Action Waiver
YOU AND PUNCH PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. NEITHER PARTY WAIVES THE RIGHT TO BRING AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT WHERE JURISDICTION IS APPROPRIATE.
15.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information.
16. Term and Termination
These Terms are effective from the date you first access or use the Website and shall remain in full force and effect for as long as you continue to use the Website or maintain an account with us, unless earlier terminated in accordance with these Terms.
We reserve the right, in our sole discretion and without notice or liability, to:
- Suspend or terminate your access to the Website or your account for any reason, including if we believe you have violated these Terms;
- Discontinue the Website or any portion thereof at any time;
- Refuse service to any user at any time.
Upon termination of these Terms for any reason:
- Your right to access and use the Website will immediately cease;
- We may delete your account and associated data in accordance with our Privacy Policy and applicable law;
- Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 6 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), 15 (Dispute Resolution), and 17 (Severability).
You may terminate your account at any time by contacting us at [email protected]. Termination of your account does not relieve you of any obligations incurred prior to termination, including payment for orders placed.
17. Changes to These Terms
We reserve the right to modify, update, or revise these Terms of Service at any time and at our sole discretion. When we make material changes to these Terms, we will notify you by:
- Updating the "Last Updated" date at the top of this page;
- Posting a prominent notice on the Website; and/or
- Sending an email notification to registered account holders where required by applicable law.
Your continued use of the Website after the effective date of any revised Terms constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Website and, if applicable, close your account. We encourage you to review this page regularly to stay informed of your rights and obligations.
18. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any one provision shall not affect the validity or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect.
The failure of Punch Pizza to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if it is in writing and signed by an authorized representative of Punch Pizza.
19. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or policies published by us on the Website, constitute the entire agreement between you and Punch Pizza concerning your use of the Website and supersede all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written, between the parties relating to the subject matter herein.
No oral statement, representation, or prior course of dealing shall modify or supplement these Terms. In the event of a conflict between these Terms and any other agreement between you and Punch Pizza, these Terms shall govern unless the other agreement expressly states otherwise in writing.
20. Force Majeure
Punch Pizza shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, government actions, civil unrest, war, labor disputes, utility failures, supply chain disruptions, or any other event that constitutes a force majeure. In such circumstances, we will make reasonable efforts to resume normal operations as quickly as practicable and will communicate updates to affected customers where feasible.
21. Consumer Rights Under Applicable U.S. Law
Nothing in these Terms of Service is intended to limit or exclude any rights you may have under applicable United States federal or state consumer protection laws that cannot be waived by contract. This includes, without limitation, rights afforded under the Federal Trade Commission Act (15 U.S.C. § 41 et seq.), which prohibits unfair or deceptive acts or practices in commerce. If you are a resident of a state with additional consumer protection statutes, those rights are preserved to the extent required by law.
California residents may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) as they relate to the collection and use of personal information, which are addressed more fully in our Privacy Policy available on the Website.
